Encumbrance Certificate Before 01-04-2004

 

Q 1 What is Encumbrance Certificate (EC)?
Ans Encumbrance Certificate (EC) is a record showing registered transactions pertaining to a property.
Q 2 How to register first time user?
Ans Open the Kaveri 2.0 URL (https://kaveri.karnataka.gov.in/landing-page) in any of the browser and in the home page click the register button, and enter the citizen details, with mobile number & e-Mail ID, then will get auto generated password to your register Mobile number/e-Mail ID, by this you can login to Kaveri 2.0
Q 3 Where can we apply for Encumbrance Certificate?
Ans  Post login to the Kaveri2.0 there is option to start new application and then select the EC option.
Q 4  Is there any option to get EC’s which are register before 01-04-2004?
Ans Yes. You need to select EC service in Kaveri2.0 & fill the required along with the EC period & esign the application and submit to SR.
Q 5 What is the search basis for EC?
Ans There are two options
A. Search by property number
B. Search by party name
Q 6 What are the required details to apply for EC with basis of search by property number?
Ans Required details need to be filled in the respective field like district, taluk, hobli/town and village.
Property-related details like Survey No and Hissa No, Khata No, Plot No etc.,
Lastly period of EC search, from date and To date. (To date should be within 1-4-2004) need to be entered correctly.
Sign is mandatory to avail a encumbrance certificate.
Q 7 Can citizen have an option to include more search parameters?
Ans Yes, enter one or more details to further improve your search (Add more option is available). Like the same we can include more search Parameters.
Q 8 Is E-sign is mandatory to get EC?
Ans  Yes, E-Sign is mandatory to avail an EC of the document searched.
Q 9 Is Adhaar mandatory?
Ans Yes, Aadhaar number is mandatory. Post completion of application completion applicant has to do esign application in FORM22 and submit.
Q 10 Is there any standard format for EC?    
Ans Yes, there are three formats for EC For Searches made on the basis of property details
1. FORM-15 – Encumbrance Certificate.
2. FORM-16- NIL EC.
For Searches made on the basis of Name
3. FORM-17- If Encumbrance is searched on the basis of name of Executants.
Q 11 What is “NIL EC”?
Ans If no deeds of transactions are registered in respect of a property mentioned in the application of EC, nil encumbrance certificates is issued. If Certificate is issued in this form, it means that there are no registered transactions / liabilities on the property for a given period of time
Q 12 Do all transactions appear on EC?
Ans No, an EC only displays transactions for a specific time period if it has been registered with the Sub Registrar's Office in Book-1. Wills and Adoption Deeds registered in Book-3 and Power of Attorney registered in Book-4 are not reflected in EC.

Form of Register Books under Registration Act, 1908,
Sub Registrar Offices
Book 1, "Register of non-testamentary documents relating to immovable property".
Book 2, "Record of reasons for refusal to register".
Book 3, "Register of wills and authorities to adopt", and
Book 4, "Miscellaneous Register".
District Registrar Offices
Book 5, "Register of deposits of wills".
Q 13 Whether pending litigations are reflected in EC?
Ans Pending litigation on the property is not reflected in the encumbrance certificate.
Q 14 Whether service of EC is under Sakala?
Ans EC is included under Sakala and the timeline for delivery of service is as follows
A. Before01-4-2004
i) For first 13years - 10 Working Days
ii) More than 13 years (for every increase in ten years) -10+1 days
Q 15 Why citizen needs EC?
Ans An encumbrance certificate is a record showing registered transactions over a property.
Q 16 How the fee is calculated for EC?
Ans Application Fee-Rs.10 Search Fee -Rs.30 (1st year) &Rs.10 (for every subsequent year)
Q 17  How do I get the Online EC Prior to 01-04-2004 after online application submission?
Ans After making payment from applicant dashboard applicant can download the EC 
Q 18 How applicant can do online payment for EC?
Ans When citizens receive a notification for payment, citizen can pay the required amount  online by selecting the payment gateway and applicable mode of payment and pay the required amount on the fly.
Q 19 Are there multiple payment modes available?
Ans Yes. There is multiple payment modes are available as below

A. Net banking – Applicant  can use their net banking-enabled account to make
     the online payment
B. Debit Card/Credit Card – Applicant can use their Debit/Credit cards which
    are provided by the bank to make the online payment
C. UPI (GPay/Phone Pay)– Applicant  can use their UPI-enabled account to
    make the  online payment

Note: Manual Payment is not acceptable.
Q 20 Is it required to visit office to collect EC?
Ans  No, after making successful payment the EC will get downloaded in citizen login.
Q 21  Details of Public Grievance System are established?
Ans Call centre or helpline has been setup for addressing the grievances - 080 68265316
Q 22  Facility available for submission of online complaint? 
Ans  Yes citizen can send mail to said emails helpdsr@karnataka.gov.in , igrshelpline@gmail.com
Q 23 Is the department interacting through its social media?
Ans Yes. The Department of Stamps and Registration actively participates to post new
